it was known prior to the priority date of the invention that it was possible to increase the stress of pei by increasing the amount of carbon black in the composition. it was also known that the slow crack propagation resistance of pei could be increased by increasing the amount of carbon black. the patent in suit further states that when the density of pei is increased by increasing the amount of carbon black in the composition, the stress holding capability of the composition is increased. there is no disclosure in the patent in suit of any bimodal ethylene polymer which has a density of at least 953 kg/m**(3), nor of any composition which has a stress holding capability of at least 10 mpa when the pipe comprised a composition including 92-99% by weight of a bimodal ethylene polymer and 1-8% by weight of carbon black.the present invention is based on the use of a composition comprising 92 to 99% by weight of a bimodal ethylene polymer and 1 to 8% by weight of carbon black, wherein said bimodal ethylene polymer which has a density of at least 953 kg/m**(3) is composed of 42-55 wt.-% of a low molecular weight ethylene homopolymer having mfr2 measured according to iso 1133 in the range of 350 to 1500 g/10min and 58-45 wt.-% of a high molecular weight copolymer of ethylene with 1-hexene, 4-methyl-1-pentene, 1-octene and/or 1-decene.the specification teaches that the method of measuring slow crack growth resistance does not define the maximum values of slow crack growth resistance attainable. it teaches that the slow crack growth resistance of the composition should be measured over the temperature range between 20 and 50 degrees c. the slow crack growth resistance is measured at each temperature by the method of astm d3974-91. the specification provides no reason or justification for modifying the test method in order to obtain a lower slow crack growth resistance. it states that the polymer composition of the invention is preferably used for forming pipes for use in high pressure applications. the specification gives no reason or justification for choosing the particular weight percentages of the ethylene polymers and carbon black in the polymer composition of the invention. it states that the bimodal ethylene polymer is preferably a blend of high and low molecular weight polyethylene produced in two successive polymerization steps with different catalyst systems. the specification gives no reason or justification for choosing particular weight percentages of the high and low molecular weight polyethylene components in the bimodal ethylene polymer, nor for choosing a particular weight percentage of carbon black in the composition.
